3.2 With Service Providers
We work with trusted third-party service providers who help us operate the Platform, including:
- Email Service Providers: To facilitate communication between buyers and brands through ticket threading
- Cloud Storage Providers: To securely store data, files, images, and videos (such as AWS S3)
- Database Services: To store and manage buyer information (such as MongoDB Atlas)

These service providers are contractually obligated to protect your information and use it only for the purposes we specify.

5.1 Where We Store Your Data
- Databases: Buyer information is stored in secure databases hosted on MongoDB Atlas
- File Storage: Images, videos, and other files uploaded for tickets are stored securely in AWS S3

- Encryption of data in transit and at rest
- Access controls and authentication mechanisms

- Secure cloud infrastructure and backup systems
5.3 Limitations
While we strive to protect your information, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security of your data.

- “Buyer” or “you” refers to any individual who has purchased a product from a participating brand and uses the Platform.
- “Brand” refers to businesses that sell products supported by Capchek.
- “Platform” refers to the Capchek Buyer Platform, including all features, tools, and services.
2. Eligibility
The Platform is available only to buyers who have purchased a product from a participating brand supported by Capchek. You represent that you are a genuine purchaser and have the legal capacity to enter into binding agreements.
3. Platform Features and Services
- Order Information: View your order details for products from participating brands.
- Expectations and Experiences: Share expectations before delivery and experiences after receiving the product.
- Support Tickets: Raise, track, and manage support tickets related to your orders.
4. User Responsibilities
- Provide accurate, truthful, and honest details about your expectations and experiences.
- Upload only genuine photos and videos of products you have actually purchased.
- Use the Platform solely for legitimate purposes related to your purchases.
- Communicate respectfully when raising support tickets or interacting with brands.
- Maintain the confidentiality of any login credentials.
5. Prohibited Conduct
- Submit false, misleading, fraudulent, or harmful information.
- Upload images or videos that do not belong to you or misrepresent products.
- Impersonate another person or provide false identity information.
- Attempt to hack, damage, or disrupt the Platform.
- Upload files containing viruses or malicious code.
- Use the Platform for unlawful, abusive, or offensive purposes.
6. Communication with Brands
Communication between buyers and brands is facilitated via email threading. Capchek acts only as a communication channel and is not responsible for the content or outcomes of responses. All communications are recorded and may be provided to legal authorities if required by law.
7. Data Collection and Usage
Capchek collects buyer details, order information, expectations, experiences, feedback, and support ticket details. This information is used to provide Platform services, enable brand communication, and generate analytics. See our Privacy Policy for details.
8. Data Sharing
Your information may be shared with brands for issue resolution, with service providers that operate the Platform, and when required by law. We do not sell your information to third parties for marketing.
9. Intellectual Property
All rights in the Platform remain the property of Capchek. You retain ownership of content you submit, but grant Capchek a license to use, process, display, and analyze your content for Platform services.
10. Security
Capchek implements reasonable security measures but cannot guarantee absolute security. You use the Platform at your own risk.
11. Your Rights

12. Disclaimer of Warranties
The Platform is provided “as is” and “as available” without warranties of any kind.
13. Limitation of Liability
Capchek shall not be liable for indirect, incidental, consequential, or punitive damages. Total liability shall not exceed fees paid in the twelve months preceding the claim.
14. Indemnification
You agree to indemnify Capchek from claims arising from your use of the Platform, violation of these Terms, or false information you submit.
15. Termination
Capchek may suspend or terminate your access at any time for violations, fraudulent activity, security concerns, or operational reasons.
16. Modifications to Terms

17. Governing Law
These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu, India.
18. Force Majeure

19. Severability

We work with trusted providers including email services, cloud hosting, database services, analytics tools, and payment processors. They are contractually obligated to protect your information.
3.3 For Legal and Safety Reasons
We may disclose information to comply with laws, enforce our Terms, detect fraud, or protect rights and safety.
3.4 Business Transfers
In the event of a merger, acquisition, or sale of assets, your information may be transferred. We will notify you of such changes.
3.5 What We Do Not Do
We do not sell, rent, or share your information with third parties for marketing purposes.
4. Communication Records
All communications through the ticketing system are recorded and may be submitted to law enforcement when required by law.
5. Data Storage and Security
Data is stored in MongoDB Atlas and AWS S3 with encryption, access controls, regular audits, and secure infrastructure. While we implement robust measures, no system is completely secure.

2. Eligibility
Available to authorized brand administrators of partnered businesses. You represent that you have legal authority to bind your organization.
3. Platform Features
- Analytics and Insights: Product-level insights, brand analytics, and reports
- Customer Experience Data: Buyer expectations, experiences, ratings, photos, and videos
- Ticket Management: View, track, and manage support tickets
- Order and Delivery Information: Monitor orders through secure integrations
4. Brand Responsibilities
- Provide accurate brand information
- Ensure only authorized administrators access the Platform
- Maintain credential security
- Use the Platform for legitimate business purposes only
- Respond promptly to buyer tickets
- Obtain necessary buyer consent for data sharing
5. Acceptable Use Policy
You must not misuse, disrupt, hack, share buyer data beyond permitted purposes, upload harmful content, reverse engineer, or use the Platform for unlawful purposes.
6. Data Collection and Usage

7. Data Sharing

20. Governing Law
Governed by the laws of India. Courts of Chennai, Tamil Nadu, India have exclusive jurisdiction.
21-25. Force Majeure, Severability, Entire Agreement, Assignment, Waiver
Standard legal provisions apply. Capchek is not liable for force majeure events. Invalid provisions are severable. These Terms constitute the entire agreement. Assignment requires Capchek consent. Failure to enforce is not a waiver.
